O R D E R

1. The parties have signed a Settlement Agreement on 16th September 2016 in terms of which counsel for the Plaintiff has handed over to the counsel for the Defendant two demand drafts bearing numbers 001850 and 001849 dated 19th September, 2016 in the sum of Rs. 4.50 lakhs each. In terms of para 14 of the settlement, the Defendant is permitted to take back custody of the goods.

2. The Settlement Agreement is taken on record. The suit is decreed in terms of the Settlement Agreement which shall form part of the decree. Decree sheet be drawn up accordingly.

3. Since the settlement has been arrived at pursuant to the mediation before CS(OS) 451/2015

the Delhi High Court Mediation & Conciliation Centre („DHCMCC‟), the Plaintiff is entitled to refund of the full court fee under Section 16 of the Court Fees Act.

4.The Registry will prepare and issue to the Plaintiff, within two weeks from today, a certificate entitling the Plaintiff to receive back from the Collector of Stamps the full amount of the court fees paid by the Plaintiff on the plaint.

5. The applications are disposed of.
