Learned counsel for the plaintiff submits that there are formal defects in the present suit, and thus, seeks to withdraw the present suit. 3.

It is to be noted that summons in the present suit are yet to be issued. 4.

Accordingly, the present suit is allowed to be dismissed as withdrawn, with liberty to file a fresh suit on the same cause of action. 5.

Pending applications also stand disposed of.
