Petition under Section 528 B.N.S.S. has been filed on behalf of the Petitioners for quashing of FIR No.0497/2019 under Sections 406/34 IPC, registered at PS: Farsh Bazar, Delhi and all consequential proceedings emanating therefrom.

Learned APP for the State and learned counsel for Resopndent No.2 appear on advance Notice.

Learned APP submits that Charges were framed by learned JMFC on 23.01.2025 and the quashing has been sought essentially on merits of the case, for which the appropriate remedy is a Revision Petition before learned Sessions Court.

Learned counsel for the Petitioners seeks permission to withdraw the present Petition with liberty to approach appropriate forum with appropriate representation.

Accordingly, the Petition along with pending Applications is dismissed as withdraw, with liberty as prayed for.
