Present appeal has been filed challenging the order dated 9th October, 2024 passed by the learned Single Judge in Cont. Case (C) 255/2023 whereby the learned Single Judge issued notice to Sh. Bhairab Dutt (presently working as Dy. Secretary Services) to show cause as to why he should not be sentenced in accordance with law under Sections 11 and 12 of the Contempt of Courts Act, 1971.

On the last date of hearing, learned counsel for the appellants, on instructions of Sh. Bhairab Dutt, Dy. Secretary Services had stated that she wishes to withdraw the affidavit dated 13th January, 2024. stated that the appellant shall abide by the affidavit dated 30th November, 2023 as well as paragraph 6 of the order dated 16th November, 2022. On the last date of hearing, this Court had directed Sh. Bhairab Dutt to file a fresh affidavit to the said effect.

Sh. Bhairab Dutt has now filed a new affidavit dated 23rd October, 2024 withdrawing his earlier affidavit dated 13th January, 2024. He is personally present in Court and assures and undertakes to this Court that the respondent No. 1's increased salary shall be paid w.e.f. 1st January, 2023 till the date she has been granted notional promotion. 4.
In view of the aforesaid statement, learned counsel for the respondents states that he would not like to press his contempt petition any further.

Recording the aforesaid statements, the contempt petition being Cont. Case (C) 255/2023 is closed. The next date of hearing before the learned Single Judge is cancelled. With the aforesaid direction, the present appeal stands disposed of.
