This Public Interest Litigation has been filed with the assertion that the respondent no.8 under the guise of an educational trust has been conferring Doctorate degrees, honorary titles and awards for a fee, illegally. Further assertion made by the petitioner is that respondent no.8 has been falsely claiming approval from the Government of India, NITI Aayog, United Nations and Other United Nations bodies. It has also been averred in the writ petition that the respondent no. 8 has allegedly been illegally uses emblems, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Primarily, the petition alleges violation of provisions of the University Grants Commission Act, 1956 and has stated that the respondent no.8 is not recognized by the University Grants Commission or any other statutory regulatory bodies, like All India Council for Technical Education, etc. 6.
Certain complaints in this regard has also been made by the petitioner to the (a) Government of India, (b) Government of Delhi, (c) Commissioner of Police, Delhi, (d) Government of Orissa, (e) Commissioner of Police, Bhubaneswar and (f) NITI Aayog, however no such representation has been made by the petitioner to the University Grants Commission. 7.
In terms of Section 22 of the University Grants Commission Act, 1956 right to conferring or granting degrees can be exercised by a University established or incorporated either under a Central or a State Act or by an entity deemed to be University under Section 3 of the said Act. Sub-section 2 of Section 22 of the said Act clearly prohibits that except in accordance with sub-section 1, no authority shall confer or grant or hold himself or itself out as entitled to confer or grant any degree.

In the aforesaid view of the matter, we dispose of this writ petition with the directions to the authorities concerned to whom the representations made to them as contained in Annexure-B and C be decided and appropriate decision thereon will be taken. We also permit the petitioner to make a representation for redressal of his grievances with the appropriate authority of the University Grants Commission and in case any such representation is made, same shall be considered and decided after proving the assertions and averments made in the writ petition.
