The present Petition has been filed assailing the Order dated 28.10.2005, passed by the Central Administrative Tribunal, Principal Bench, Delhi [hereinafter referred to as „Tribunal‟], whereby the order of the Disciplinary Authority imposing penalty of withholding five increments of the Respondent without cumulative effect was set aside/quashed.

This Petition has come up for hearing after a lapse of about 20 years.

Learned counsel representing the Petitioner is unable to apprise the Court as to whether the Respondent, upon attaining the age of superannuation, has demitted office or not. Upon a perusal of the list of dates and events placed on record; it appears that the Respondent had submitted an application for earned leave in the year 1996. 4.
