The instant writ petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioner seeking the following reliefs:- "a. Mandamus directing the respondent to release the petitioner on parole for a period of two months in case arising out of FIR No. 53/2013. PS: MUNDAKA,DELHI, b. Pass any other order or further orders, which this Hon'ble Court deems fit and proper in the interest of justice;" 2.

During the arguments, learned ASC for the State, appearing on advance notice, submitted that the competent authority has already passed the order dated 18th October, 2024, rejecting the application of the petitioner herein seeking release on parole. The copy of the said order has been placed before this Court as well as handed over to the learned counsel for the petitioner. The same is taken on record.

At this juncture, learned counsel appearing on behalf of the petitioner seeks leave of this Court to challenge the aforesaid rejection order in accordance with law.

In view of the above, leave granted. The petitioner is at liberty to challenge the rejection order dated 18th October, 2024 passed by the competent authority in accordance with law.

With the aforesaid direction, the petition stands disposed of. 7.
