O R D E R

By way of the present petition filed under Article 266 of the Constitution of India, the petitioner seeks directions for being released on his first spell of furlough for a period of three weeks in FIR No. 81/2010 registered under Sections 304/34 IPC at P.S. Sadar Bazar, Delhi. 2.

Learned counsel for the petitioner submits that the petitioner's representation came to be dismissed by the Competent Authority vide communication dated 05.08.2024 on the ground that after being released on emergency parole, the petitioner was re-arrested in another case being FIR No. 37/2021 registered under Sections 307/34 IPC at PS Sadar Bazar, Delhi. 3.

A copy of the Status Report, alongwith nominal roll of the petitioner has been handed over in Court, which is taken on record. As per the nominal roll, the last punishment awarded to the petitioner was meted out on 10.04.2021 for the aforesaid reason. Considering that the last punishment awarded to the petitioner was more than three years back and as per the statement of the learned ASC for the State that petitioner's address stands verified, the petition is allowed and petitioner is directed to be released on his 1st Spell of furlough for a period of three weeks from the date of his release, on his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the concerned Jail Superintendent, subject to the following conditions:

(i) Petitioner shall report to the concerned SHO once a week on every Monday during the period of furlough.

(ii) Petitioner shall furnish his telephone number to the SHO concerned, which he will keep operational at all times.

(iii) Petitioner shall surrender before the Jail Authorities at the expiry of the period of furlough.

The writ petition is disposed of in the above terms. 6.
