The present writ petition has been filed seeking directions to the respondent no. 1 to take action against the unauthorized construction, carried out by respondent no. 2, at the property bearing No. C-7 (Back Side of Tarak Hospital), Jai Bharat Enclave, Vipin Garden, Najafgarh Road, Uttam Nagar, New Delhi-110059.

Responding to the present writ petition, learned counsel appearing for the Municipal Corporation of Delhi ("MCD") submits that a Show Cause Notice has already been issued on 18th September, 2025, and that the matter The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. has been fixed for personal hearing of respondent no. 2-owner/occupier of the property in question on 30th September, 2025.

He further submits that a letter has also been written to Station House Officer ("SHO"), Police Station-Mohan Garden, Uttam Nagar, New Delhi, rd on 23 September, 2025, in order to ensure that no further unauthorized construction is carried out in the property in question. 4.

Considering the submissions made before this Court, the MCD is directed to take appropriate action against the property in question, after following the due procedure and in accordance with law. 5.

In case, any party is aggrieved by any action or non-action on part of the MCD, their right to seek their remedies in accordance with law is reserved.

With the aforesaid directions, the present writ petition, along with the pending application, is disposed of.
