CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 02.05.2018 After some arguments, the learned counsel for the appellant submits that without prejudice to his rights and contentions, he would not press the matter but would request that the Trial Court be directed to expedite the hearing of the case and that it be disposed off as early as possible.

In view of the above, the Trial Court is requested to endeavour to dispose off the case by the end of the year.

The learned counsel for the parties submit that they would not take more than two weeks each to record their evidence on the date so fixed by the Trial Court.

They further state that they would assist the Trial Court on every date when the case is listed and will not seek adjournments on any count whatsoever.

The appeal is dismissed as withdrawn in terms of the above. NAJMI WAZIRI, J MAY 02, 2018/acm
