This Petition has been filed under Section 11(5) and (6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator to adjudicate on the disputes which have arisen between the parties under the Purchase Order dated 21.02.2022.

Material on record indicates that the Respondent approached the Petitioner for the manufacturing and supply of OHE Copper Conductors for a Railway Electrification Project. Thereafter, the Respondent issued the Purchase Order for 26 MT (25.778 MT) of material valued at Rs.2,53,90,622.86/- on 21.02.2022. Dispute arose between the parties regarding payment of money.

Clause 13 of the Purchase Order contains an Arbitration Clause. A notice dated 10.10.2024 under Section 21 of the Arbitration and Conciliation Act, 1996, was sent by the Petitioner to the Respondent invoking Arbitration and claim a sum of Rs.70,81,339/- which according to the Petitioner is due The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and payable by the Respondent. A reply to the said notice was received by the Respondent on 02.11.2024 denying all the liabilities and, therefore, the Petitioner has, therefore, approached this Court by filing the present Petition. 4.
In view of the fact that disputes have arisen between the parties and there is an arbitration clause in the Purchase Order, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 5.
Accordingly, Mr. Vivek Kishore, Advocate (Mob No: 9899780111) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act within two weeks of entering the reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression on the merits.
The present petition stands disposed of in the above terms along with pending application(s), if any.
