% 26.07.2016 IA No. 8685/2016 This is an application filed on behalf of the plaintiff seeking a direction for refund of the amount of `51,95,600/- deposited by the plaintiff in this Court. None is present on behalf of the plaintiff. However, the learned counsel for the defendant reaffirms that the disputes between the parties are settled and in terms of the settlement, the plaintiff is entitled to withdraw the aforesaid sum. Accordingly, the application is allowed. IA No. 8686/2016 The learned counsel for the defendant states that although the parties were referred to Mediation, however, the parties could not settle their disputes before the Delhi High Court Mediation and Conciliation Centre; the settlement was arrived at, subsequently, outside the Court.

In the circumstances, the application for refund of Court Fee cannot be allowed. The same is, accordingly, dismissed. VIBHU BAKHRU, J JULY 26, 2016 RK
