present petition may not be maintainable, though it is that the subject suit is not maintainable. To that extent, the clarification rendered by learned senior counsel for respondent no.2 is accepted.

In view of contents of paragraph 12 of the impugned order, after part arguments, learned senior counsel for respondent no. 1 seeks a pass over to take instructions if the impugned order can be set aside with consent without looking into the rival contentions and directions be issued to the learned appellate court to decide the application afresh within one week after hearing both sides on 18.12.2025 when the matter is already listed there. In this call, all learned senior counsel on instructions of their respective briefing counsel submit that without prejudice to their respective contentions, the impugned order may be set aside and matter be remanded to the learned appellate court with the directions to pass a reasoned order within 10 days from 18.12.2025 when the matter is already listed before the learned appellate court.

Consequently, with consent of both sides, the impugned order is set aside and the order passed by the learned trial court is restored. 5.

The learned appellate court shall hear all parties afresh on the date already fixed i.e., 18.12.2025 and shall decide the application under Section 151 CPC (which had led to the order impugned in these proceedings) within 10 days from 18.12.2025.
