O R D E R

After arguments, this appeal is disposed of with the consent order that the respondent will pay to the appellant/plaintiff a sum of Rs.12,90,000/- along with interest at 8.5% per annum simple from 15.6.2006 till payment. Respondent is however granted time of six months to make payment under the present order, but in case the amount as stated in the present order is not paid by the respondent to appellant within six months then rate of interest will become 18% per annum.

On the appellant receiving the amount in terms of today's order no claim of any party will survive against the other which is subject matter of the present litigation.

Appeal is accordingly disposed of in terms of the aforesaid order, leaving the parties to bear their own costs. RFA 248/2018

Amount deposited by the appellant in this court when the suit was pending in this Court, be refunded by the Registry to the appellant along with accrued interest after calling for the suit file from the trial court.
