Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioner, Chander Shekhar for quashing of FIR No.1252/2014 under Section 304A/288 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Malviya Nagar, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 05.02.2024.

As per the FIR, Mr. Sujeet Kumar had died on 23.09.2014, through electrocution while working for the Petitioner. The Charge-Sheet has been filed on 14.02.2024 i.e. after almost 10 years, on which cognizance has been taken. No Application for condonation of delay or explaining the delay, has been filed on behalf of the Prosecution. The Settlement has been effected between Ms. Veena Devi, wife of the deceased and the Respondent No. 2, Mr. Ramjappu Mahato, father of the deceased with the Petitioner/Accused. As per the Settlement, Rs.50,000/- had been given to the family on 24.09.2014 and Rs.1,00,000/- has been given to the family on 27.09.2014 i.e. soon after the accident. Further amount of Rs.3,00,000/- has been paid on 18.02.

2023, after which the present Settlement has been executed ,which bears the thumb impression of the wife of the accused and the signatures of the father of the deceased. The Respondent No. 2, Mr. Ramjappu Mahato, father of the deceased is present in the Court and endorses the terms of the Settlement and submits that wife and the children of the deceased, are residing in Bihar and he is taking care of him and the money receipt has been transferred to their account.

On the Complaint of the Respondent No.2/Complainant, FIR No. 1252/2014 under Section 304A/288 of IPC, got registered at Police Station Malviya Nagar, Delhi.

Today, the Respondent No. 2/Complainant, who is present in the Court, states that he has no objection if the said FIR is quashed. 7.

The parties have been identified by their Counsel and Investigating Officer concerned and have been entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 1252/2014 under Section 304A/288 of IPC, registered at Police Station Malviya Nagar, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly. Pending Application, if any, stands disposed of.
