This is a joint application filed on behalf of the parties under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ('CPC') for recording of compromise.

The application has been signed by the authorised representative of the plaintiff and the defendant and is duly supported by their affidavits. 3.

The terms of the settlement are recorded in paragraph 3 of the application.

I have gone through the terms of the settlement and find the same to be lawful.

5.

The parties shall remain bound by the terms of the settlement. 6.

The application stands disposed of.

In light of the order passed in I.A. 3019/2025 above, the present suit is decreed in favour of the plaintiff and against the defendant in terms of paragraph 53 (i) to (vi) of the plaint. The aforesaid application shall form part of the decree.

Since the matter has been settled at an early stage, the Registry is directed to issue a certificate of refund of 50% of the Court Fees in favour of the plaintiff, in terms of Section 16A of the Court Fees Act, 1870.
