He submits that a settlement was arrived at before the Counselling Cell of the Family Court on 25.08.2017 and as per the settlement he had to pay a sum of Rs. 5 lakhs to the petitioner in full and final settlement, out of which a sum of Rs. 2.50 lakhs was to be kept in the fixed deposit in the name of the minor daughter.

He submits that a sum of Rs. 2.50 lakhs has already been paid. However, the petitioner has not furnished proof that the said amount has been kept in a fixed deposit in the name of the minor daughter. He submits that another sum of Rs. 2.50 lakhs is to be paid at the time of recording of the statement on the second motion which is scheduled CRL.REV.P. 157/2017

for tomorrow. He submits that the said amount of Rs. 2.50 lakhs shall be paid to the petitioner before the concerned court at the time of recording of settlement as has been agreed between the parties. 4.

Since none appears for the petitioner, the petition is dismissed for non prosecution.
