A Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of Criminal Case No.1920/2017 arising out of FIR No.71/2012 on the basis of mediated Settlement Agreement dated 26.11.2012.

Counsel for the Complainant has submitted that the Petitioner failed to abide by the terms of the Settlement and, therefore, the quashing in terms of Settlement was opposed. In the present case the Chargesheet had been filed on 28.02.2017 before the Trial Court and the Charges have been framed on 19.03.2024 and the matter is listed for Prosecution Evidence. 3.
