Vide order dated 16.01.2025, applicant/accused was granted interim bail till the next date of hearing. The interim bail was extended by subsequent orders dated 11.02.2025, 03.03.2025 & 10.03.2025. 2.

Learned counsel for the applicant submits that the applicant has been suffering from multiple ailments including hyper-tension, diabetes, obesity and requires surgery for piles. He further submits that presently, the applicant is in Chennai and has recently undergone Endoscopy. He has made a request for grant of extension of interim bail for 08 weeks time for getting necessary treatment.

submitting that applicant has been misusing the liberty of grant of interim bail, inasmuch as, despite seeking interim bail for 12 weeks, he has availed the liberty of interim bail for more than 3 months. It is submitted that the applicant is not suffering from any serious ailment, and therefore, the interim bail may not be extended.

As per the prescription of the doctor dated 30.01.2025 placed on record by the applicant himself, the applicant is suffering from hypertension, diabetes, bronchial asthma, Obesity, bleeding piles, fatty liver, depression and osteoporosis. Applicant is not suffering from any such ailment, as mentioned in the doctor's prescription for which, treatment is not available at jail hospital or the government hospital while staying in jail. 5.

Admittedly, initially, in the petition, the applicant had prayed only for 12 weeks interim bail, but has got it extended from time to time and has enjoyed the liberty of bail for more than 3 months by now. 6.

Keeping in view the entire facts and circumstances and in particular the fact that treatment can be provided to the applicant while remaining in jail, the application is disposed of with directions to the applicant to surrender before the Superintendent, Jail within a week. However, Superintendent Jail is directed to ensure that the requisite treatment as per the advice of the doctor is provided to the applicant/accused. 7.

Copy of this order be also sent to Superintendent Jail for information and compliance.
