Learned counsel for the appellant submits that without prejudice to his rights and contentions with regard to his income and means, he is willing to comply with the order dated 16th December, 2015 passed by the learned Family Judge directing payment of litigation expenses to the tune of Rs.11,000/-, if he is permitted to pay the said amount in instalments. This appears to be a fair and reasonable offer.

We direct that the appellant shall pay the litigation expenses in four equal instalments of Rs.2,750/- each to the respondent. The first instalment shall be positively paid within one week from today by way of sending a money order at the residence of the respondent. MAT.APP.(F.C.) 35/2016

This appeal is disposed of in the above terms. This order is passed without prejudice to the rights and contentions of both the parties. 4.
