Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as „B.N.S.S.‟) has been filed on behalf of the Petitioner, Arvind Kumar Jaghamani for setting aside the Order dated 20.03.2025 and to restore the accompanying Petition. 2.
Learned counsel for the Respondent No. 2, as well as, the learned APP for the State, have no objection if the Application is allowed. 3.
The reasons given in the Application for non-appearance on 20.03.2025, is that the learned counsel was busy in another Court. 4.
Considering the submissions made, the Application is allowed and the accompanying Petition is restored to its original number. Petition under Section 528 of B.N.S.S, 2023/under Section 482 of Cr.P.C. has been filed on behalf of the Petitioner, for quashing non-bailable warrant dated 05.08.2024, issued by learned JMFC, Patiala House Courts, New Delhi and all subsequent proceedings emanating from the FIR No. 301/2017 under Section 498-A/406/420/120-B and 34 registered at Police Station Inderpuri, Delhi.

After some arguments, learned counsel for the Petitioner, seeks permission to withdraw the present Petition with liberty to approach the learned Trial Court with an appropriate Application. 8.
Petition is permitted to be withdrawn with liberty as prayed for and disposed of accordingly.
