Petitioner seeks quashing of FIR No.340/2016 under Sections 354A/354/509 IPC, Police Station Gandhi Nagar, based on a Settlement.

The petitioner, at that relevant point of time, was a tenant in the property of respondent No.2 - the complainant herein. 3.

Parties have amicably settled their dispute with the intervention of friends and family.

The Memorandum of Settlement dated 19.02.2018 has been executed between the parties. 4.

The Settlement records that the dispute occurred on the spur of the moment and with the intervention of the friends and family, the

parties have agreed to amicably settle their disputes with a view to restore peace and harmony between them.

The petitioner is present in Court in person. He has regretted his mistakes.

Respondent No.2 is present in Court in person is and identified by the Investigating Officer. She confirms that they have arrived at a Settlement with a view to maintain peace and harmony between them and further submits that she does not wish to press her complaint any further.

In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of family and friends with a view to restore peace and harmony between them and a Settlement has been arrived at between the parties, and further they do not wish to press charges against each other, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.340/2016 under Sections 354A/354/509 IPC, Police Station Gandhi Nagar, and the consequent proceedings emanating therefrom are hereby quashed, subject to the petitioner depositing costs of Rs.5,000/-, which shall be paid to the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh

Vihar, Village Mandoli, Delhi, within a period of two weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today.
