CRL.M.C. 8467/2024 3.

This is a petition under section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') seeking quashing of FIR No. 0575/2022 under sections 498-A/406/34 IPC dated 13.08.2022 registered at Police Station - Pandav Nagar and consequential proceedings emanating therefrom. 4.

Petitioners are present in Court and have been identified by their counsel, Mr Neeraj Malik.

5.

Respondent No. 2 is also present in Court and has been identified by her counsel Mr Raul Lal Akhriya as well as by the Investigating Officer, SI Dheerendra Kumar, PS-Pandav Nagar.

6.

It is stated that the parties have arrived at a settlement dated 12.01.2024 before the learned Family Court Karkardooma, Delhi pursuant to which the petitioners had to pay a sum of Rs. 20,50,000/- to respondent No.2, out of which Rs 11,50,000 has already been paid and the balance sum of Rs. 9,00,000/- has been paid today in Court by way of Demand Draft No. 067004 dated 23.10.2024 drawn on 'The Hongkong and Shanghai Banking Corporation Limited'.

7.

Both parties state that they have entered into the aforesaid settlement out of their own free will, volition and without any threat, force, undue influence or coercion. It is stated by respondent No.2 that she has no objection if the FIR is quashed.

8.

There is no child born out of the wedlock.

9.

Since the parties have arrived at a settlement and no disputes are pending, I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further. It is a fit case for quashing. In this view of the matter, there is no reason to continue the proceedings. 10.

In this view of the matter, FIR No. 0575/2022 under sections 498A/406/34 IPC dated 13.08.2022 registered at Police Station - Pandav Nagar and consequential proceedings emanating therefrom are hereby quashed. 11.

The petition is disposed of accordingly.
