Crl.M.A.12917/2017 (extension of parole) in W.P.(CRL) 657/2017 The petitioner has sought extension of the parole which was granted to him by order dated 07.07.2017.

It has been submitted on behalf of the petitioner that he had undergone knee surgery and because of stiffening in the ligament he was advised certain exercises which are not possible in jail. It is further submitted on behalf of the petitioner that he has enrolled himself in a swimming centre and is also undertaking cycling exercises in accordance with the medical report. It has been submitted that the exercises would be important for him to recover fully.

The period of parole terminates on 12.08.2017. Taking into account the aforesaid facts, this court is persuaded to extend the parole for a further period of two weeks to be counted from 12.08.2017.

The period of parole is extended for a further period of two weeks. The petitioner shall positively surrender before the jail authorities on the expiry of two weeks when counted from 12.08.2017. The other conditions which were imposed upon him by order dated 07.07.2017 shall continue and any departure/breach of the aforesaid conditions would entitle the State to approach this court for cancellation of the order granting parole/extension of parole.

The application is allowed.
