In the aforesaid speaking order, it has been stated that the construction of excess coverage/extension of flats on the common courtyard in the subject property had been carried out prior to the year 2007 and hence, is entitled to protection under the National Capital Territory (Special Provision) Act, 2007.

In light of the aforesaid, no direction with regard to the demolition of the said property can be passed by this Court and the petition is disposed of accordingly.

Mr. Vivek Tandon, counsel appearing on behalf of the petitioner, submits that the aforesaid findings in the speaking order that the construction was carried out prior to 2007 are not correct. 6.

In view thereof, liberty is given to the petitioner to initiate appropriate remedies that may be available in law.

All rights and contentions of the owner/occupier/private respondents shall remain protected.
