Learned counsel for the appellant submits that taking into account that a period of one year has already elapsed since separation of the parties, he has instructions not to press the present appeal any further. The same is, alongwith accompanying application, accordingly, disposed of as not pressed making it clear that it will be open for the parties to approach the learned Family Court for dissolution of their marriage by mutual consent as per law.

Further, taking into account the age of the parties, it is made clear that it will be open for the learned Family Court to consider their prayer for waiver of the six months period prescribed for filing of the Second Motion Petition for divorce.
