A petition under Section 482 Cr.P.C. for cancellation of bail has been preferred by State against order dated 22.09.2021, whereby, respondent No. 2 was granted bail by the concerned Court for offences under Sections 354/354A/354B/376/323/506/313/34 IPC and Section 8 POCSO, registered at PS: Samaypur Badli.

Considering the delay in challenging the order, an affidavit was directed to be filed on behalf of the State vide order dated 26.04.2024. In view of order dated 26.04.2024, learned APP for State seeks to place on record affidavit of Mr. Mukesh Kumar, APP. He further submits that there is change in circumstances, after the bail was granted by learned Trial Court, since the victim did not support the case of the prosecution. Learned APP for the State further seeks to withdraw the application for cancellation of bail.
