The instant petition under Articles 226/227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking the following reliefs: "a) To issue a writ, order or direction in the nature of mandamus against the respondent No. 2 to 4 for causing unwarranted/ malicious harassment, mental agony to the petitioner and for misusing the power's vested in them by law; and b) To issue a writ, order or direction in the nature of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

mandamus, directing Respondent No. 2 to 4 to file a status report with respect to FIR No. 0345, U / s 342/506 IPC, dated 2.08.2024, PS: Uttam Nagar, District: Dwarka, Delhi; and c) To issue a writ, order or direction in the nature of mandamus thereby quashing the FIR No. 0345, U / s 342 / 506 IPC, dated 2.08.2024, PS: Uttam Nagar, District: Dwarka, Delhi qua the petitioner; and d) To issue any other appropriate writ, order or direction thereby staying the operation/ execution In respect to FIR No. 0345, U/s 342/506 IPC, dated 2.08.2024, PS: Uttam. Nagar, District: Dwarka, Delhi qua the petitioner; and e) To issue any other appropriate writ, order or direction which this Hon'ble Court deems just and proper, in the facts and circumstances of the present matter; and f) Pass any other further order(s) which this Hon'ble Court may deem fit and proper In these circumstances, in the interest of justice."

After some length of arguments, learned counsel appearing on behalf of the petitioner, without pressing the matter on merits, made an innocuous prayer that the petitioner may join the investigation on the date as fixed by this Court.

Learned ASC appearing on behalf of the respondent-State has no objection to the innocuous prayer made by learned counsel for the petitioner.

Since the petitioner is not pressing the matter on merits, the learned ASC for the State has no objection to the innocuous prayer made by learned counsel for the petitioner that the petitioner may join the investigation and appear before the investigating agency on the date fixed by this Court. Accordingly, this Court directs that the petitioner shall appear before the concerned Investigating Officer on 5th November, 2024 at 3:00 P.M. 5.
