Present Habeas corpus has been filed by the mother of the girl child, aged 4 Years, under Article 226 of the Constitution of India read with Section 528 BNSS, 2023 seeking directions to the respondents to produce her daughter 2.

The petitioner and respondent No.4 (husband of petitioner) reside and work in Jaipur, Rajasthan, whereas, the minor girl child resides with respondent No. 4 in Fatehabad, Agra. 3.

Since the issue does not arise in Delhi, this Court does not have the territorial jurisdiction to entertain the present petition. After hearing arguments for some time, learned counsel for the petitioner prays to withdraw the present writ petition with liberty to file the same before the Court having jurisdiction or to take any other appropriate legal remedy, before appropriate Forum. 5.

In view of the above, the present petition is dismissed as withdrawn.
