Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.')/under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No. 0257/2023 dated 31.07.2023 under Section 323/326/341/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Delhi Cantt. and all the consequential proceedings emanating therefrom, on the grounds that the matter has been settled within the Complainant and the injured. 2.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

The Affidavits of the Complainant and the injured, are annexed along with the Petition.

The Respondent No. 2 is also present in person. However, as per the FIR, the injuries were inflicted with a knife and the blade of the knife got left in the body of the injured, which was removed subsequently in the hospital. The offences are 323/326/341/34 of IPC read with Section 25/54/57 of the Arms Act.

Considering the gravity of the allegations and also that the weapon had been used for inflicting injuries, it is not a fit case for quashing the FIR No. 0257/2023 dated 31.07.2023 under Section 323/326/341/34 of IPC, registered at Police Station Delhi Cantt. and all the consequential proceedings emanating therefrom.
