Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of Order No. F-18/122/2009/PT-1/ HG/2698-2701 dated 04.09.2025 and direct the Respondent to release the Petitioner on Parole for two months on medical grounds.

Issue Notice. Learned counsel for the State appears on advance Notice and submits that ground for release on parole no longer exists. 3.

Petitioner is at liberty to move a fresh Application, which shall be considered in accordance with Delhi Prison Rules, 2018. 4.

Learned counsel for the Petitioner has expressed an apprehension that generally Application for Parole is not being decided within the statutory time frame. However, learned counsel for the State assures that the same shall be disposed of within the timeframe given in Delhi Prison Rules, 2018.
