The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Article 226 of the Constitution of India, seeks the following relief:

"a) Issue a Writ/Order/Direction m the nature of mandamus, thereby directing Ld. CJM, Shahdara District, Karkardooma Court, Delhi to expedite the decision in the Cr. Case No. 4579/2020 titled as State Vs. Devender Sharma, arising out of FIR No. 672/2015, P.S. Jyoti Nagar, Delhi, and pass the final judgment within a maximum period of three months;"

Counsel for the Petitioner states that despite the filing of the chargesheet, the proceedings before the Trial Court are not progressing. 3.

does not find any ground to exercise the jurisdiction under Section 528 of BNSS. This Court cannot monitor the board of the Trial Court. The scheduling of dates is determined by the concerned Judge, taking into account several factors such as the judge's docket, the urgency, vintage and complexity of the matter. If the Petitioners have valid reasons for an expedited hearing, the proper course of action would be to file an appropriate application before the Trial Court seeking the said relief. 4.

Accordingly, the petition is disposed of along with pending application.
