% 22.05.2018 CA No.626/2018 This application has been filed by the OL to pass a final winding up order against the respondent company.

It has been pointed out that on 03.12.2014 this court had appointed the OL as the provisional liquidator with the direction to take charge of all the assets and records of the respondent company. The details are given of the steps taken by the OL regarding the assets of the respondent company. The fund position of the respondent company is Rs.49,892/-. There is no asset of the respondent company. Even claims have not been invited as there is no asset or fund available. Accordingly, the application is allowed. The company is directed to be wound up. The publication of the winding up notice in the newspaper is also dispensed with. The fund of Rs.49,892/- may be transferred to the common pool fund on account of the expenses incurred by the OL. The application is disposed of.

CO.PET. 252/2013 In view of the order passed today in CA No.626/2018, the present petition stands disposed of. Respondent company is directed to be wound up. All the pending applications, if any, also stand disposed of. JAYANT NATH, J.
