% 17.05.2018 The learned counsel for the appellant submits that the respondent's application under Order 7 Rule 11 of the CPC has been allowed by the Trial Court by an order dated 02.05.2018. In other words, the appellant's suit has been dismissed.

In view of the above, and on account of some development in the courts in Malaysia, the learned counsel for the appellant seeks to withdraw the appeal.

Accordingly, the appeal and the application are dismissed as withdrawn.
