O R D E R

By way of present bail application, the applicant seeks interim bail in FIR No. 587/2024 registered under Section 21 of the NDPS Act at PS Narela Industrial Area, Delhi on the ground that his wife is presently in an advanced stage of pregnancy.

Ld. APP for the State submits that applicant is an accused in a case where seizure of 280 grams of heroin was effected at his instance. He further submits that the applicant's family consists of his father, mother, sister and second wife who can take care of the applicant's pregnant wife and hence his presence is not required. However, it is submitted that the factum of applicant's wife being pregnant is verified and she is stated to be in her ninth month of pregnancy and her expected date of delivery was 23.10.2024. 3.

pregnant has been verified and the expected date of delivery, the applicant is directed to be released on interim bail for a period of one week from the date of his release, subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty Judicial Magistrate and subject to the following conditions :- i) Petitioner shall not leave the Delhi NCR without prior permission of the concerned Court;

ii) Petitioner shall report to the SHO of the concerned police station once in a week during the period of his release;

iii) Petitioner shall not directly/indirectly try to get in touch with the prosecution witnesses or tamper with the evidence; iv) Petitioner shall surrender after the expiry of the interim bail period. 4.

The bail application is disposed of in the above terms alongwith pending applications.
