O R D E R

% 14.03.2016 The present petition has been filed seeking setting aside of the order dated 30.11.2015 passed in Criminal Appeal No.19/2/2015 by learned ASJ who while dismissing the appeal of the petitioner upheld the order of conviction and sentence passed by the learned MM against the petitioner to undergo Simple Imprisonment for three years and to pay fine of Rs.2,000/- and in default thereof, to undergo further Simple Imprisonment for one month under Section 380/34 IPC. During the course of arguments, it has been submitted that the fine already stands deposited by the petitioner and the petitioner does not want to challenge the order of court below on the merits of the

case.

Consequently, the conviction of the petitioner is upheld. It has been further submitted by the learned counsel for the petitioner that the petitioner has already undergone Simple Imprisonment of two years and nine months and prays that the petitioner be released on the sentence already undergone by her.

In view of the same, this Court is of the considered opinion that the present revision petition qua the challenge to the conviction of the petitioner by the court below which was upheld by the learned Appellate Court, does not have any merit.

In view of the facts and circumstances of the case, the sentence of the petitioner is reduced from 3 years to 2 years and nine months. The petition stands disposed of.

A copy of the order be sent to the concerned Superintendent Jail.
