The petitioner herein is having an award in its favour which was published on 18th March, 2024.

Feeling aggrieved, the non-claimant has already filed an application under Section 34 of Arbitration and Conciliation Act, 1996 which is pending consideration before the concerned Commercial Court. 3.

During course of the above said proceedings, an application under Section 19 of Micro, Small & Medium Enterprises Development Act, 2006, was filed.

The sole grievance raised in the present petition is that learned Commercial Court has fixed up the matter for 19th November, 2024 whereas, in view of the clear cut spirit and intent of said provision, the application CM(M) 3724/2024 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
