This rectification petition is filed on behalf of the Petitioner for cancellation of the entry pertaining to impugned registration of Respondent No. 19s device mark 8LEGACY/ 9 bearing Application No. 5358936 in Class 33 having Certificate No. 3086331 from the Register of Trade Marks.

Parties have amicably settled their disputes and have agreed to coexist in relation to liquor business, limited to the boundaries of India.
