These petitions have been filed seeking quashing of FIR no. 44/2018, registered at PS Rani Bagh, Delhi under Sections 498-A/406/34 IPC and FIR no. 88/2018 under Sections 452/506 IPC registered at Rani Bagh, Delhi respectively based on settlement arrived at between the parties dated 16th July, 2023 which is on record of this Court.

As per the settlement, the total settlement amount is Rs. 50 lacs, out of which Rs. 30 lacs is already been paid; the outstanding balance of Rs. 20 lacs is being tendered today vide two DD Nos. 985759 and 000383 to the respondent no. 2 who is present in Court. The same has been handed over to respondent no.2 who has duly received it in Court. 2.
Petitioner no.1 and respondent no. 2 are present in Court and are duly identified by IO and the respective counsel.

Petitioner nos. 2-4 who are the family members of the petitioner no.1 had been exempted from appearance by order dated 25th October, 2024 of this Court.

The marriage of petitioner no.1 and respondent no.2 has resulted in a divorce by a decree dated 28th July, 2023. One daughter was born out of wedlock.

Respondent no. 2 has no objection to the quashing of the FIR. 6.
Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 44/2018 under Sections 498-A/406/34 IPC registered at PS Rani Bagh, Delhi and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 8.
Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.

It is however made clear that the said settlement will not affect the rights of the minor child in future.
