By way of the present appeal, the appellant seeks to assail the judgment of conviction dated 06.01.2018 and the order on sentence dated 08.01.2018 passed by the learned ASJ-01 (East), Special Court under POCSO Act, Karkardooma Courts, Delhi in SC No. 304/2016 arising out of FIR No. 542/2013 registered at P.S. Kalyan Puri for offences under Section 354 of IPC.

Vide the order on sentence, the appellant was directed to undergo rigorous imprisonment for a period of ten years and to pay a fine of ₹15,000/-, in default whereof to further undergo simple imprisonment for two months for the offence punishable under Section 6 of the POCSO Act. He was further sentenced to undergo rigorous imprisonment for a period of seven years and to pay a fine of ₹5,000/-, in default whereof to further undergo simple imprisonment for two months for the offence punishable under Section 452 IPC. All sentences were directed to run concurrently and the benefit of Section 428 Cr.P.C. was granted. 2.

Appellant has joined the proceedings from Jail through V.C. and identified by Jail Warden Kapil, Jail No. 14, Mandoli Jail. Learned counsel for the appellant on instructions from the appellant, states that he does not wish to pursue the appeal as he would be completing his sentence on by tomorrow. It is further submitted that appellant has also deposited the fine on 19.08.2025 which is confirmed by the Jail Warden Kapil. 3.

In view of the above, present appeal is disposed of as not pressed and appellant be released on his completing sentence on 29.08.2025 subject to confirmation of deposit of fine and if not required in any other case. 4.

At this stage, learned counsel appearing for Delhi State Legal Services Authority submits that compensation amount as awarded by the Trial Court has already been disbursed and received by the victim and in this regard a report has been placed on record.
