The writ petitioner is aggrieved by certain observations and conclusions arrived at in the final report submitted by Jain Commission which went into the events and circumstances leading to the death of Late Sh.Rajiv Gandhi, Prime Minister of India.

The main direction sought for is that the Central Bureau of Investigation should not initiate any action against the petitioner, his associates, friends and relations under the garb of notice for investigation with reference to binding arrived at by the Jain Commission. 3.
From time to time status reports were filed.

Counter affidavit filed by CBI evinces that a multiple disciplinary W.P.(CRL) 190/2005
monitoring agency has been constituted and case RC-9(S)/91CBI/SCB/MAS has been registered. The counter affidavit filed way back on October 08, 2000 is to the effect that investigation is on. 5.
On May 26, 2009 another counter affidavit was field annexing therewith an order passed by the Presiding Officer of the designated Court under TADA.

It appears that with the passage of time the issues raised by the petitioner have been rendered either infructuous or are a non-issue and this explains no representation from the side of the petitioner. 7.
The writ petition is accordingly dismissed for non-prosecution. 8.
No costs.
