Since counsel for the caveator has entered appearance, the caveat stands discharged.

C.M. Appl. No. 9528/2018 (for exemption) 2.

Exemption allowed, subject to all just exceptions. C.M. stands disposed of.

RFA 249/2018 and C.M. Appl. No. 9527/2018 (for stay) 3.

After arguments, this appeal is disposed of as not pressed, but as agreed appellant is granted time to vacate the suit premises on or before 31.12.2018 but subject to the appellant clearing all arrears, if any, at the admitted rate of rent of Rs.23,000/- per month for a period RFA 249/2018

of three years prior to filing of the suit till date within a period of two months from today and in this regard appellant will be entitled to any adjustment for any rent for this period which is either deposited in this Court or paid to the respondent.

Appellant will also clear all charges towards electricity, water, etc. as payable for the suit premises till the appellant remains in possession of the suit premises. 4.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within two weeks from today and on the appellant filing the undertaking and complying with the terms of the same, appellant will have time to vacate the suit premises on or before 31.12.2018.
