The petitioners seek quashing of FIR No. 40 of 2018 under Sections 323/341/427/506/379/34 of the IPC Police Station Dwarka North, New Delhi, based on a settlement.

The complainant as well as petitioners are stated to be friends. It is contended that on account of a misunderstanding the subject incident occurred, and a fight took place between the parties. It is further contended that with the intervention of the respective members of the family who are also family friends, the disputes between the parties have been settled and a settlement agreement dated 15.02.2018 has been executed. It is contended that the parties are friends and they continued to be friends.

Respondent no. 2 is present in person in Court today and is CRL.M.C. 1163/2018
identified by the Investigating Officer. He submits that he has settled the disputes with the intervention of senior family members and respectable people of the locality. Respondent No. 2 submits that he does not wish to press the criminal complaint against the petitioners any further.

In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No. 40 of 2018 under Sections 323/341/427/506/379/34 of the IPC Police Station Dwarka North, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed. 6.
