After arguments, this appeal is disposed of as not pressed because admittedly appellant was not a party to the subject suit which has resulted in the impugned judgment dated 29.1.2018 and therefore judgment in the suit will not operate as res-judicata so far as the appellant is concerned, obviously with respect to any legal rights which the appellant has and which would be established in accordance with law in an appropriate court.

The appeal is accordingly disposed of with the aforesaid observations.
