O R D E R

% 09.03.2018 Mr. Sagar, learned counsel appearing on behalf of the petitioner, after some arguments, states that he limits the prayer in the present petition to issue a direction to the learned DRAT to dispose off the Appeal No. 389/2015, arising out of OA No. 67/2009 instituted by him, expeditiously, subject to his depositing a sum of Rs. 16,85,471/-; the amount stated in the recovery certificate, before the learned DRAT. Learned counsel appearing on behalf of the Bank on advance notice does not fairly oppose the proposal made on behalf of the petitioner.

In view of the foregoing, subject to the petitioner depositing the said sum of Rs. 16,85,471/- within five weeks from today, the learned

DRAT is directed to dispose off the said appeal instituted on behalf of the petitioner as expeditiously as possible and preferably within a period of six months from the next date of hearing i.e. 20.03.2018. No coercive steps shall be taken against the petitioner till the disposal of the appeal by the Recovery Officer.
