Present writ petition was disposed of on 25.10.2024 and while disposing of the writ petition, petitioner was directed to be given an opportunity to inspect the relevant record and was also permitted to appear before the concerned official through videoconferencing and simultaneously, his authorized representative or chartered accountant/financial expert were permitted to appear in person before the authority concerned. 2.

It seems that such direction was passed keeping in mind the fact that petitioner was in his seventies.

Simultaneously, there was a direction to the bank to take a decision after personal hearing given to the petitioner within 21 days of the filing of the reply.

The present application has been moved by IDBI Bank praying therein that time for disposal may be extended to two months to be reckoned from 13.12.2024.

Learned counsel for petitioner appears on advance notice and has no objection if the time is accordingly extended. However, at the same time, he has pointed out that notice of personal hearing received by the petitioner is in teeth of the specific directions given by this Court as the concerned bank has categorically specified in the communication dated 16.12.2024 that the petitioner is advised to attend the hearing in person and he would not be assisted by any third party viz. lawyer/chartered accountant/consultant etc. 6.

During course of the hearing, learned counsel for the bank, in all fairness, submitted that personal hearing would be given in terms of the specific directions passed by this Court and he would instruct the bank accordingly to do the needful.

Application under disposal is allowed and the time is extended till 13.02.2025.
