By way of this petition under Article 226 of the Constitution, the petitioner seeks a direction upon the Municipal Corporation of Delhi ["MCD"] to refund an excess amount paid in respect of trade license registration fee by the petitioner.

It is the case of the petitioner that it applied for a trade license in April, 2024, but erroneously stated in its application that the area of its premises was 3,300 sq.mts. rather than 3,300 sq.ft. It therefore, paid an amount of Rs.3,26,775/- by way of license fees, instead of the payable amount which would have been in the region of Rs.35,000-40,000/-. 3.

10.05.2023, which shows the area of the premises leased by it prima facie appears to be 3,300 sq.ft. The petitioner has also made representations to the MCD on 26.04.2024 and 27.05.2024, which have not elicited a response.

At this stage, N.K. Sharma, learned counsel for the petitioner, seeks a direction upon the MCD, to pass a reasoned order on its representations within a fixed time frame.

Mr. Manu Chaturvedi, learned counsel for the MCD, who appears on advance instructions, states that a reasoned order will be passed within eight weeks from today, and if the petitioner has made any excess payment as alleged, the refund will also be processed within four weeks thereafter.

The writ petition is disposed of in terms of Mr. Chaturvedi's submission recorded above, without prejudice to the rights and contentions of the petitioner to challenge the order passed by the MCD, if necessary.
