% 07.03.2018 Vide the present petition, the petitioner has impugned the Office Order dated 9th February, 2018 passed by respondent no.2 and the Transfer Order dated 12th February, 2018 passed by respondent no.3. Ms.Monika Arora, learned counsel for the respondents who appears on advance notice, submits that the respondents propose to withdraw the said Office Order No.26/CP/2018 dated 9th February, 2018 and the Transfer Order dated 12th February, 2018. She, however, submits that the said orders are being withdrawn only as the respondents propose to issue fresh orders after giving a show cause notice to the petitioner and then pass appropriate orders after considering the reply of the petitioner.

In view of the aforesaid statement by learned counsel for the respondents, the impugned Office Order dated 9th February, 2018 and

the Transfer Order dated 12th February, 2018 are treated as withdrawn.

Needless to state that the respondents would be at liberty to take appropriate action against the petitioner based on the same allegations, after following due procedure of law. In view of the aforesaid statement made by learned counsel for the respondents, learned counsel for the petitioner seeks liberty to withdraw the petition.

In case the petitioner is aggrieved by any order passed by the respondents, he will be entitled to take legal recourse as per law. The petition and application are dismissed as withdrawn. Dasti.
