By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks modification of certain bail conditions imposed vide order dated 11.02.2022 passed by the learned CMM, Patiala House Courts, New Delhi.

At the outset, Ms. Sonia Mathur, learned senior counsel appearing for the petitioner submits, that she has instructions to say that the petitioner is dropping the prayer for modification of condition No.3, namely the condition requiring the petitioner to take prior permission of the court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
before leaving the country; and is restricting his prayer in the present proceedings only to modification of condition No.2, namely that the petitioner's passport that has been surrendered to the court be returned to him.

Ms. Mathur submits, that the petitioner is seeking return of his passport in order to keep it renewed, if and when so required, so that he does not have the approach the court for that purpose. Learned senior counsel further submits, that though the petitioner would of course seek prior permission of the court before travelling-out of the country, but if he gets his passport back, the time required for obtaining permission to travel abroad would also be saved.

Ms. Mathur states that a similar bail condition imposed on co-accused Zakir Khan has also been modified to the same extent vide order dated 22.10.2024 made by a Co-ordinate Bench of this court in CRL.M.C. No.3503/2024. A copy of the said order has been shown in court. 5.

Mr. Gagan Vaswani, learned counsel is present on behalf of Mr. Satish Aggarwala, learned senior standing counsel for the respondent on advance copy; accepts notice; and does not oppose the limited prayer made.

In view of the above, the present petition is disposed-of modifying only condition No.2 contained in order dated 11.02.2022 made by the learned CMM, Patiala House Courts, Delhi, thereby directing the learned trial court to return to the petitioner his passport that he has surrendered before that court, within 02 weeks of an application to that effect being made by the petitioner to that court. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is made clear that no modification has been made in any of the other conditions imposed vide order dated 11.02.2022. More specifically, the petitioner would be required to take prior permission of the learned trial court before travelling out of the country. 9.
