The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 487/2022 dated 14th November, 2022, registered under Sections 498A/406/34 of the Indian Penal Code, 18603 at P.S. Badarpur, Delhi and all other proceedings emanating therefrom.

The petition is filed by the sister, uncle (Chacha), and aunt (Chachi) 1 "BNSS"

of the Complainant's husband. It is noted that the FIR records only the Complainant's allegation that "her in-laws" had assaulted her. These allegations have been verbatim reproduced in the chargesheet, which are only to the above effect.

Ms. Guninder Kaur Gill, counsel for the Petitioners, further submits that the chargesheet contains no other material evidence, such as witness testimonies, to support the aforementioned allegation. Additionally, the statement of one prosecution witness, allegedly a neighbour of the complainant in Delhi, does not contain any specific allegations against the Petitioners and amounts only to hearsay.

In the opinion of the Court, all the grounds urged in the present petition can easily be urged before the Trial Court, at the stage of arguments on point of charge.

Accordingly, the present petition is disposed of, granting liberty to the Petitioners to raise all the grounds urged herein before the Trial Court at an appropriate stage. If the decision of the Trial Court is not favourable to the Petitioners, they are granted liberty to pursue appropriate remedies in accordance with law.
